Rail Terms and Conditions

To Purchase:

Rail passes cannot be issued to residents of Europe, Russian Federation, Turkey, Morocco, Algeria or Tunisia. Residents of United Kingdom are not eligible to purchase BritRail Passes or Eurail Passes. 

How to Activate (Validate) and Use Your Rail Pass:

  • Rail passes are issued  and must be activated (validated) within six months from the date of purchase.  To activate (validate) the rail pass, present the rail pass along with your passport to the Railways official at the station of departure. At this time, the first and the last day of validity of the rail pass as well as the passport number is entered and the traveler must sign the rail pass. Under no circumstances is the pass holder allowed to activate (validate) his or her own rail pass. In the case of a flexi pass, the traveler must enter the date of travel each day before he/she boards the first train of the day. Failure to comply with this requirement may result in the payment of a fine and the cost of a full fare ticket. Also, if there is any indication that a rail pass has been tampered with, forged and or/used by anyone other than the passholder, or used beyond its validity, the railway Officials are authorized to confiscate the rail pass and full payment will be required  plus a fine for that and future trains. It is compulsory to present passports to railway officials on request.
  • In most cases validity runs from midnight to midnight for the period shown on the rail pass. All services, rail, rental car, air travel and travel bonuses must he be used within the validity of the accompanying rail pass. One-month period is based from a date in one calendar month to the corresponding date in the following month (minus one day). Depending on the calendar month the pass is validated, the validity period may therefore consist of 28, 29, 30 or 31 days.
  • Rail passes are not valid on hotel trains, private or specialty trains unless otherwise stated.  The Glacier Express Swiss scenic train is only covered by the Swiss Pass.  Discounted tickets are available for Eurail Pass holders to cover the private railroad if purchased in advance.  
  • Rail passes are available in first and second class unless stated otherwise. Travelers holding first class rail passes are also permitted to travel in standard/ second class however a refund of the  price difference is not applicable. Travelers holding standard/second class passes are permitted to travel in first class only if they pay the difference between the two tickets as applicable locally. For BritRail passes: Some trains in Great Britain do not have first class accommodations. The price of the first class passes have been adjusted to reflect this.

Refunds are limited to completely unused, undated, unvalidated, unactivated rail passes, ticket and inclusive packages, hotel and car vouchers and will be granted only where permitted under the terms and conditions set forth below or elsewhere in this site. Rail passes, tickets and vouchers must be returned for refunds. Companion and Saver passes, BritRail discounted and Eurail Select Pass, Rail 'n Drive rail passes together are considered one document and must be submitted together. No refunds will be granted on partially used rail passes or tickets, or on unused parts of inclusive packages; documents must bear no evidence of having been tampered with in any way.

7:00pm Rule:

The number of days used on your pass when traveling on an overnight train will vary depending upon the situation.

  • Overnight train trips departing after 7:00pm and traveling through at least 4:00am (with no change of train) require the traveler to only enter the following day's date on the pass (which means only one travel day is counted).
  • Overnight train trips departing after 7:00pm and traveling through at least 4:00am (with any change of train) count as two days of travel.
  • Overnight train trips departing after 7:00pm and arriving before 4:00am counts as two days of travel.

Seat Reservations:

Having a rail pass does not guarantee a seat. Seat reservations are optional on some of the trains however they are mandatory for traveling on high speed trains (TGV, Thalys, AVE, Eurostar, Le Frecce), international trains (Lyria, Talgo), night trains (Elipsos, Thello, City Night Line) and scenic trains (Glacier Express, GoldenPass, Bernina Express, William Tell Express, Chocolate Train). The ICE requires reservations on all Sprinter train. Additionally reservations are required on the X2000 in Scandinavia and most trains in Spain (Renfe). Also, some trains require the payment of a surcharge, which includes the compulsory seat reservation. On some trains the number of seats available for pass holders may be limited. It is highly recommended to make reservations in advance. If reservations for pass holders are sold out on your desired train, you will either need to select a different train that has reservations available or purchase a ticket at the best available price. The cost for the reservation varies depending on the type of train and country. Rail Europe can secure seat and night train reservations for your trip before you depart North America, this ensures that you will have a seat on the train you wish to travel on.

Overnight Travel:

European night trains offer a variety of accommodations to suit all budgets. Most night trains offer sleeping compartments and couchettes, and some also have reclining seats.

Couchettes and reclining seats are the most economic type of accommodations. Couchettes are not gender specific; they consist of four bunk beds in first class and six in second class. A blanket and pillow is provided, but you sleep in your day clothes. Reclining seats are available on selected trains and generally in second class only.

For more comfort and privacy, you can reserve a sleeping compartment in first class accommodating one or two travelers or second class for two or three travelers. Though the compartment may include a wash basin it does not have a private toilet. Toilet facilities are located at the end of each car. Some night trains also offer deluxe compartments with a private toilet and shower. Sleeping compartments are gender specific, except when couples or families occupy all of the beds.

Night accommodations must be reserved and paid for in advance. On some night trains the number of accommodations for pass holders may be limited. It is highly recommended to make reservations in advance. Prices vary depending on the type of accommodation and country.  If reservations for pass holders are sold out, you will either need to select a different date that has available accommodations or purchase a ticket at the best available price.  Rail Europe can secure seat and sleeping compartment reservations for your trip before you depart North America, this ensures that you will have a place on the train you wish to travel on.

Additional Charges:

Reservations for seats, sleeping compartments and couchettes, for travel on trains such as Eurostar, Le Frecce, AVE, Talgo, Elipsos, Thalys, , etc. luggage checking, and port taxes, are all subject to additional charges which are not covered by the rail passes. The prices for all BritRail passes include a processing fee. These, including meals and refreshments, are all to be paid separately. Luggage checking, port taxes, meals and refreshments as well as  reservations for seats, sleeping compartments and couchettes reserved locally must be paid abroad in local currency.

British Train Tickets:

The British rail systems may offer additional fares for some British trains. These fares can be accessed through our call center. Rail Europe offers all British train tickets in compliance with the National Conditions of Carriage and specific Ticket Restrictions and Terms. Tickets are not eligible for purchase by British(UK) residents. Validation of residency is required to purchase British train tickets.

Travelers Purchasing Italian Tickets:

The exchange rate applied to Trenitalia tickets is 1.4039 Euro/USD or 1.4460 Euros/CAD.

Travelers Purchasing Italian International Tickets:

The exchange rate applied to Trenitalia tickets is 1.4039 Euro/USD or 1.4460 Euros/CAD.

Travelers Purchasing Thello Tickets:

The exchange rate applied to Trenitalia tickets is 1.4039 Euro/USD or 1.4460 Euros/CAD.

Governing Rules:

All transportation covered by those rail passes where use is intended for more than one country is subject to the Uniform Rules concerning the Contract for International Carriage of Passengers and Luggage by Rail (CIV). National and/or single-country rail passes are subject to rules and regulations of their specific countries. Neither the British nor European railroads nor Rail Europe, Inc. assume any responsibility for damages resulting from a strike.

Refund:

  • Applications for refunds must be submitted by the client to the office where the rail pass, train ticket or reservation was purchased. Expired tickets/passes are non refundable. No refund can be made unless the UNUSED rail pass or train ticket can be produced. No refund will be made in Europe for tickets/passes issued by Rail Europe, Inc. No refund can be given on tickets/pass purchased in Europe. Rail passes, paper tickets or reservations must not be removed from their ticket cover and must bear no evidence of having been tampered with in any way. Refund amounts are posted to the original form of payment.
  • E-tickets may be refunded before the train departure date and/or as per the policy indicated on the confirmation email.E-tickets can be refunded either online or by emailing the Customer Relations Department at customerrelations@raileurope.com.
  • Online refunds are not available for rail passes, paper tickets, tours, city sightseeing, airport transfers, travel cards, Swiss Packages, etc.
  • Online refunds are only available for orders paid with one credit card.
  • Eurail Global Passes, Eurail Select Passes, Eurail Regional and National Passes are refundable only if totally unused and unactived or unvalidated (non-validated) and received within one year from the issue date. Six months for the BritRail Pass.
  •  All refunds are subject to minimum 15% cancellation fee. Rail 'N Drive passes are not refundable if either the rail or car portion has been used. Saver Passes, Twin Passes and Party Passes are not refundable if activated (validated) or partially used.
  • Trains tickets are refundable based on the "after sales" rules of the type of ticket purchased. Fare rules are provided in your confirmation email, and also printed on the paper ticket.
  • Paper ticket must be received in our office within the time frame allowed for a refund.
  • Depending on the product, cancellation fees vary and some products are non refundable. All refunds are subject to a 7% administrative fee per ticket.
  • Totally unused tickets received by the issuing office prior to the first date of validity are refundable. Tickets received after the first day of validity are refundable if canceled and stamped "not-used" by a railway official, at the station of departure prior to the first date of validity based on the after sales policy of the ticket. These tickets are refundable up to 30 days from your return to North America. All refunds are subject to a 15% cancellation fee and are subject to a 7% administrative fee. Tickets submitted after the first day of validity, which have not been canceled, are not refundable. 
  • Sleeping Compartments and Couchettes: For cancellations in North America, the unused ticket must be received by Rail Europe at least 24 hours before the train departure date. If clients are in Europe, ticket must be stamped canceled by a railway official at the station of departure at least 24 hours before the train departure date. Cancellation fee applies. If space not canceled and ticket received after the travel date, ticket is non refundable.
  • Non-refundable Products: Paris Visite, Paris Museums, London Travel Card, Fly-Rail Baggage, Fast Baggage in Switzerland, Original London Sightseeing Tour, Visitor Oyster Card, Rail Protection Plan™, Seat Reservations.
  • Refunds are not available on any delivery options, this includes the service fee, shipping and handling fees.
  • Where no other time frame for refund is specified on this website, refund requests for train tickets, rail passes, tours & packages must be received by Rail Europe within 30 days of your return to North America. Once tour/package is confirmed a refund is not allowed. Special refund conditions apply to Swiss packages - please check at the time of booking.
  • Please note that refunds are processed during normal business hours: Monday through Friday between 9:00am to 7:00pm ET.

Exchange:

  • Online exchanges are only available for e-tickets.
  • Online exchanges can only be performed up to and including the train’s travel date. Most exchangeable tickets are only exchangeable prior to the train departure time.  If a ticket is exchangeable after the travel date, the exchange can be done only by calling the issuing office.
  • Online exchanges are subject to a 5% exchange fee.
  • For all other exchanges, please contact the issuing office. When exchanging ticket/passes, the original ticket/pass must be received by Rail Europe in order to finalize the exchange.
  • Exchanges are subject to an exchange fee and a new shipping and handling fee. Should there be a price increase this will also be collected at the time of the exchange.
  • Fares and schedules are subject to change and are not guaranteed until ticketed.
  • All Exchanges are subject to up to 7% administrative fee per ticket.
  • Please note that exchanges are processed during normal business hours: Monday through Friday between 9:00am to 7:00pm ET.

Seating:

Most trains offer only nonsmoking accommodations, but some trains offer smoking and non-smoking.

Payment:

American Express, Diners Club, Discover, Visa or MasterCard are accepted.

Lost Train Tickets and Rail Passes:

Rail Europe, Inc. is not responsible for rail passes, train tickets or vouchers which are lost, stolen, mutilated or destroyed. Refunds cannot be authorized in such cases. To protect yourself against such losses please refer to our Rail Protection Plan™.

Advance Booking:

Please apply for your rail passes and other tickets at least 7 business days prior to your departure from North America. Rail Europe, Inc. will always try to help if less notice is given, but Rail Europe, Inc. is not responsible for delays in delivery service or otherwise. If a product is ordered at short notice, Rail Europe, Inc. will charge an additional fee for overnight delivery service. When ordering, please include your date of departure from North America.

Responsibility/ Liability:

  • Rail Europe, Inc. acts only as a booking agent. Rail Europe, Inc. has no control over, and is not responsible for, any of the tours, rail passes, attractions, hotels and other travel accommodations listed in this site. All bookings are accepted and all tickets, rail passes, and vouchers are issued on the express condition that, Rail Europe, Inc. is not responsible or liable for any loss (consequential or otherwise); damage (including but not limited to loss of, or damage to travelers' clothes, baggage, or other property whatsoever); death, injury, delay, inconvenience or irregularity caused by, or arising out of, or in connection with, any defect in any vehicle or other, air, land or sea conveyance used, rented or traveled in; or through the negligence, willful misconduct, strikes or other acts, defaults of omissions of any carrier, car rental company, hotel, restaurant or any other provider of goods or services.
  • Every booking is accepted subject to the conditions, tariffs and regulations imposed by the air, rail, shipping, bus, car rental, car insurance, hotel or other companies, firms or persons concerned.
  • Rail Europe, Inc. reserves the right to alter, cancel or substitute any component of a package.
  • All items of a personal nature not specifically mentioned such as phone calls, tips, taxis, etc. are the responsibility of each traveler.

General Terms and Conditions:

All orders are subject to a shipping and handling fee of $18 USD/CAD unless otherwise noted. All prices and terms and conditions are subject to change.

NOTE: The following terms and conditions apply to all rail passes, Rail 'n Drive passes: Combination passes that include rail and car. Please carefully read these terms and conditions for all combination passes, etc.

  • Travelers are responsible for ensuring that they have all necessary visas and appropriate travel documents PRIOR to their departure from North America.
  • Certain trains may transit through a country not covered by their rail pass. In that case an additional train ticket must be purchased. Therefore please carefully review your route.
  • Train schedules and fares are subject to change and availability. Fares and departure times will be confirmed upon purchase confirmation. Sleeping compartment prices vary and will be confirmed at time of purchase.
  • Please note that Rail Europe is an independent company, and that Rail Europe does not own nor control any of the railroads and/or products offered by Rail Europe.
Note: All prices in this guide are correct at time of printing. Rail Europe, Inc. reserves the right to change prices without notice whether such changes are related or not to alterations in rates of exchange.

Rail Plan Protection™:

Rail Europe, Inc. (“REI”) is pleased to offer its Rail Protection Plan (RPP) for all European rail passes, train tickets, reservations and select city passes and tours issued through our company.

  • Exchanges: Whatever your reason you can make one (1) exchange for a new rail pass/train ticket/reservation/city pass/tour with no questions asked. Please note that rail passes/paper tickets/paper reservations/city passes/tours must be received by REI two (2) business days prior to the original departure date from North America given at the time of booking. E-tickets (Print at Station/Print at Home) can be exchanged up to two (2) business days prior to the original scheduled train departure date. Travelers are responsible to pay the difference in price between the exchanged product and the new order. In case the price of the new ticket / pass is lower than the original product, the difference will not be refunded.
  • Cancelations: Whatever your reason you can cancel your rail pass/train ticket/reservation/city pass/tour at no penalty, no questions asked. Travelers will be issued a REI credit in the form of a coupon code equal to the value of the canceled products that may be used for one (1) future order within two years from issue date. Please note that rail passes/paper tickets/paper reservations/city passes/tours being returned for a cancelation must be received by REI no later than two (2) business days prior to the original departure date from North America given at the time of booking. Cancelation requests for e-tickets (Print at Station/Print at Home) must be received no later than two (2) business days prior to the originally scheduled train departure date.
  • Strikes: If while traveling in Europe, your trip is interrupted or stopped due to a rail strike, you will be reimbursed for the value of the unused train ticket/reservation. This provision only applies to unused train tickets/reservations and does not apply to rail passes/city passes/tours.
  • Loss or Theft: You’ll receive reimbursement on your rail pass/train ticket/paper reservation/city pass/tour that is lost or stolen while traveling in Europe. Under the Rail Protection Plan, Rail Europe will either refund the value of the unused portion of the lost or stolen rail pass/train ticket/paper reservation/city pass/tour or the cost of a replacement rail pass/train ticket/paper reservation/city pass/tour, whichever is less.

How do I apply for an exchange?
To request an exchange, please contact us at CustomerRelations@raileurope.com or call 800-438-RAIL (7245).

  • Rail passes/train tickets/reservations/city passes/tours - may be exchanged for the same or new products.
  • Rail pass/paper ticket/reservation/city pass/tour – exchanges must be received by REI Customer Relations department no later than two (2) business days prior to the scheduled departure date from North America. New rail passes/paper tickets/reservations/city passes/tours/coupons codes are not released until the original documents have been received by REI. Exchanges on these paper products cannot be performed after the travelers have departed North America.
  • E-tickets (Print at Station/Print at Home) – exchange requests must be received by REI at least two (2) business days prior to the regularly scheduled train departure date. Exchange requests received within two (2) business days of the scheduled train departure date will be not be processed.
  • The value of the original product will be applied to the new order. Travelers who have not yet determined their new travel dates (or if tickets are not available yet for purchase) will be issued a coupon code equal to the value of the exchanged product(s) that may be applied to a new order at a later date.
  • Coupon Codes are issued in the name of the traveler(s) given at the time of the original booking and are non-transferable.
  • Coupon Codes issued for an exchanged product are for one (1) time use and must be redeemed on a new order no later than two (2) years from the issue date on the coupon code. No refund will be issued in cases where the full value of the coupon code is not used.
  • Standard shipping fees and exchange fees are waived for the new order. Overnight or express shipping fees are not included and would be additional.
    NOTE – Coupon Codes issued for future orders cannot be applied toward shipping and handling fees.
  • No explanation is required for exchange requests on rail passes/train tickets/reservations/city passes/tours.

How do I apply for my REI credit in the case of a cancelation?
To request a REI credit, please contact us at  CustomerRelations@raileurope.com or call 800-438-RAIL (7245).

  • Rail passes/paper tickets/paper reservations/city passes/tours being returned for a cancelation must be received by REI. Customer Relations department no later than two (2) business days prior to the scheduled departure date from North America given at the time of booking.
  • E-tickets (Print at Station/Print at Home) – cancellation requests must be received by REI at least two (2) business days prior to regularly scheduled train departure date. Exchange requests received within two (2) business days of the scheduled train departure date will be not be processed.
  • Travelers will be issued a REI credit in the form of a coupon code equal to the value of the canceled products that may be applied to a new order at a later date.
  • Coupon Codes issued in the name of the traveler(s) given at the time of the original booking and are non-transferable.
  • Coupon Codes are for one (1) time use and must be redeemed on a new order no later than two (2) years from the issue date on the coupon code. No refund will be issued in cases where the full value of the coupon code is not used   
  • Coupon Codes cannot be applied toward shipping and handling fees.
  • No explanation is required for exchange and cancelations requests on rail passes/train tickets/reservations/city passes/tours, no questions asked.
How do I request reimbursement if there has been a strike?
  • Requests for reimbursement due to strikes must be sent to REI including the RPP Traveler’s Request Form and the train ticket/reservations, which must have been stamped at the European rail station by a railway official indicating the train ticket/reservation was not used due to a rail strike. Rail passes/city passes/tours are not covered in cases of rail strikes.
  • Request due to strikes for printed e-tickets must follow the procedure mentioned above. If e-ticket has not been printed, requests for cancellations must be emailed to customerrelations@raileurope.com before the train departure time.
  • Notice of any requests for paper or printed e-tickets/reservations due to strikes or loss/theft from travelers who traveled to Europe must be given within thirty (30) days of their return from Europe.
How do I apply for reimbursement due to loss or theft?
  • Rail pass/train ticket/paper reservation/city pass/tour must file a police report within twenty-four (24) hours of the incident.
  • Travelers must purchase a replacement rail pass/train ticket/reservation/city pass/tour in order to continue with his/her travel plans.
  • Within thirty (30) days upon return to North America, rail pass/train ticket/paper reservation/city pass/tour must submit a statement to REI including the police report, replacement rail passes /train tickets/paper reservations/city passes/tours purchased abroad, RPP Traveler’s Request Form, airline tickets from North America to Europe and return and a brief explanation of the situation.
  • Coverage does not apply for rail passes/paper tickets/paper reservations/city passes/tours lost prior to departing North America.
  • Loss or theft coverage does not apply to travelers with Print at Home e-tickets.

Download and fill out the RPP Traveler’s Request Form. All requests involving rail passes/paper tickets/reservations/city passes/tours must be submitted in writing to REI Customer Relations Department, 9450 W. Byrn Mawr Ave., 4th floor, Rosemont, IL, 60018 and must be accompanied by the appropriate documentation listed in the sections above.

It is recommended that rail passes/paper tickets/paper reservations/city passes/tours being returned for a claim under this program be sent by a traceable mail service to ensure delivery. In the event these product(s) are sent regular mail and is not received, no claim can be processed.

This plan is administered by REI and can be revised or terminated at our sole discretion at anytime with or without notice. In the case that Rail Protection Plan is terminated, only rail passes/train tickets issued prior to the date of termination will be covered.

Description of Rail Protection Plan™:

Exclusions: This program does not apply to any loss caused by:

(a) Delay or detention or confiscation by Customs Officers or Officials or Police or other Security Officers.
(b) Rail pass/paper tickets/paper reservations/city passes/tours not in clients’ actual possession at the time of loss.
(c) Acts of god, war, invasion, act of foreign enemy, hostilities (whether war be declared or not), terrorist acts, civil war, rebellion, revolution, insurrection, military or usurped power.
(d) Any dishonest, fraudulent or criminal act by the rail pass/ticket holder.
(e) Damage due to wear and tear, gradual deterioration, vermin or inherent vice.
(f) No change to this program will be valid unless authorized solely by REI.
(g) No legal action can be brought against REI to recover until sixty (60) days after we receive a RPP Traveler’s Request Form. 
(h) No legal action against REI may be brought more than one (1) year after the time for submitting the RPP Traveler’s Request Form as mentioned herein. Further, no legal action may be brought against REI unless all the terms of the RPP have been complied with fully.
(i) Any provision of this program that is in conflict with applicable law is hereby amended to conform to minimum requirements of such law and the rail pass/ticket holder agrees to the jurisdiction of New York County, New York.
(j) Some products may already include some of the benefits under the Rail Protection Plan. Please consult your terms and conditions for selected products prior to purchasing the Rail Protection Plan. 
(k) Coupon codes issued for exchanged product may be combined with other promotional coupon codes offers but ONLY over the phone in the REI Contact Center by calling 800-438-RAIL(7245).

Refund Policy

  • Rail Protection Plan™ is non-refundable and non-exchangeable.
  • If you make any claim knowing it to be false or fraudulent in any respect, no benefit shall exist for such claim and your benefits may be canceled. Each claimant agrees that representations regarding claims will be accurate and complete. Any and all relevant provisions shall be void in case of fraud, intentional concealment, or misrepresentation of material fact.

Car Terms and Conditions

Car Rental

Responsibility of Avis/Hertz is subject to the Terms and Conditions in the Avis/Hertz Rental Agreement. Standard rental requirements apply. Car rental vouchers must be used by date noted on the vouchers. Basic car rental is for Economy Car with manual transmission, including unlimited mileage, local taxes (VAT). Drop off fee is applicable for car rentals picked up in one country and dropped off in another. Free drop-off is permitted at select locations within country of rental. A service charge is due on rentals picked up at airport locations and a few railway stations. Certain restrictions may apply. All drop-off conditions are subject to change and should be confirmed at time of reservation.

Rail 'n Drive programs (excluding Eurail Italy Rail 'n Drive):

include unlimited mileage and local tax (VAT)

Eurail Italy Rail 'n Drive:

includes unlimited mileage, Collision Damage Waiver, Theft Protection and local tax (VAT).

RATES DON'T INCLUDE:

Gas, Collision Damage Waiver, Theft Protection and/or Personal Accident Insurance (unless stated otherwise), fees for an additional and/or young driver, airport surcharges, registration tax or car group upgrades made locally. In some countries, or for a few car groups, a service charge is due on one-way rentals.

Collision Damage Waiver ("CDW") and Theft Protection Insurance("TP"):

CDW and TP, where available may vary by car group and country. These options limit the renter from responsibility for damage to or loss of the rental car, unless it results from use as prohibited by the rental agreement. A nonwaivable excess will remain on the charge of the customers in case of damage to or loss of the car even if the CDW/TP has been accepted. This nonwaivable excess varies by country and car group.

MINIMUM AGE:

Cars may only be rented by drivers 25 (Hertz) or 23 (Avis) years of age or older, who have a valid North American driver's license issued at least one year prior to rental, and who present a current major credit card in their name (American Express, Diner's Club, Discover, Visa or MasterCard). The driver's license must be presented at commencement of the rental.

There is a maximum age for rentals in Ireland.

RENTAL PERIOD:

Each voucher is issued for a specific number of days of car rental and must be surrendered at time of rental. Each day consists of a 24 hour period. Additional time for which no voucher has been presented will be charged at the prevailing higher local daily rate for each full or partial day. Additional days must be purchased in North America at the time of booking or they will be charged at the prevailing local rate.

Automatic cars are not available in all locations/countries such as Romania, Finland. Please check at the time of reservations.

REFUNDS:

Car vouchers are not refundable or replaceable if lost or stolen, except as covered by the Rail Protection Plan™ (Rail 'n Drive only). A Rail 'n Drive Pass may only be refunded when it is received at the issuing office prior to the first date of validity printed on the pass and none of the components of the package, rail and/or car, have been used. The pass must be returned in its entirety, unused. Any allowed refund is subject to a 15% cancellation charge.

ADDITIONAL TERMS & CONDITIONS FOR THE RAIL 'N DRIVE PROGRAMS:

Rail 'n Drive passholders must present their rail pass together with the car rental vouchers.

Notice of all changes that materially affect ways in which your personally identifiable information may be used or shared will be posted in updates to our Privacy Policy. Collection, Use, and Accessing of Information

Information Collection

Whether you make a purchase, register for an account, or are just a visitor, we are very careful with what we do with your information. Collection of information is usually grouped into two categories: personally identifiable, which is information identifiable to a specific user, and non-personally identifiable, which is general demographic information (gender, age, zip code), as well as  RailEurope.com Site-wide usage information (route and destination popularity, pages visited, promotion participation levels).

We collect non-personally identifiable information when it is affirmatively provided or through online activity such as “cookies” and other tracking technologies, which are discussed in greater detail below. We may use non-personally identifiable information for any purpose or disclose it to anyone. Where the two categories of information are combined, the resulting information is treated as personally identifiable information in accordance with the terms of this Privacy Policy.

Some of the personal information we collect may be stored or processed on computers located outside your jurisdiction of residence, including both in the United States and France, whose data protection laws may differ from the jurisdiction in which you live. In many cases, you can view the RailEurope.com Site without telling us who you are or revealing any personally identifiable information. However, if you wish to purchase a rail pass or other ticket, you will have to provide information required of any traveler. This includes your name, and your email address, as well as the names of anyone traveling with you. If you select an age-specific ticket or pass, such as “youth” or “senior,” you also must provide your age group and that of anyone traveling with you, as applicable. Further, you must provide us with your valid payment information, including credit card numbers and expirations dates (all such foregoing information, collectively, “Data”).

Since Rail Europe is only the distributor of products and services provided by third parties (“Suppliers”), we also are collecting your Data on behalf of those Suppliers. For example, these Suppliers will need each traveler’s name and age group for identification purposes and to verify that each pass or other ticket is being used in accordance with that Supplier’s terms and conditions. Our collection of and disclosure to our Suppliers of your Data is a required part of your transaction, and you agree by engaging in such transactions on the RailEurope.com Site to such collection and disclosure.

If you make purchases with us often, you may want to set up an account with us by registering on the RailEurope.com Site. This will make it easier for you to complete your purchases quickly. As a registered RailEurope.com Site user, you also may elect to receive newsletters and similar emails from us with travel news and information. Registered users of the RailEurope.com Site should be mindful of password-entry requirements and not disclose account numbers or passwords to others. Please read the Terms of Use for further information about your rights and responsibilities in maintaining an account with us.

Apart from purchases and registration, from time-to-time, we also request information via surveys, contests, in sweepstakes or other promotions, polls, and you may send questions or comments to us via email.   Participation in these activities is completely voluntary and you may choose whether or not to participate and therefore disclose this information.  In such a case, we will collect personally identifiable information when you choose to participate in sweepstakes or other promotions, fill out surveys, complete polls, or send questions or comments to us via email. Please read below for more information on how we use information collected through these means.  Information requested may include contact information (such as name and shipping address), and demographic information (such as zip code, age level). Contact information will be used to notify the winners and award prizes. Survey information will be used for purposes of monitoring the use of this site and improving customer satisfaction.

We do not knowingly collect information from children under the age of 13, and require that those making purchases on the RailEurope.com Site be 18 years of age or older and the age of legal majority in the jurisdiction where they reside. Should a child whom we know to be under 13 send personal information to us, we will use that information only to respond directly to that child to inform him or her that we must have parental consent before receiving his or her personal information. Each travel product or service also may be subject to age restrictions, and we reserve the right to impose further restrictions on those or similar purchases.

Data Use for Transactional and Promotional Purposes by Rail Europe

We and our service providers who assist us in connection with RailEurope.com Site operations may retain and use Data and other personally identifiable information, as well as non-personally identifiable information, in providing the RailEurope.com Site to you, which uses may include, without limitation, the following:

  • to facilitate your purchases of rail, car and travel passes and other ticketed travel products and services that we distribute;
  • to complete your travel-product purchase transactions by disclosing your Data to our Suppliers
  • to administer such purchases and provide reminders and follow-up information regarding your purchases and travel plans;
  • to send you email newsletters, at a registered RailEurope.com Site user’s election, about Rail Europe and the many exciting destinations to which we offer travel;
  • to allow participation in our various promotional programs, including sweepstakes and contests, that we may offer from time to time;
  • to inform you of other types of services we or our Suppliers offer;
  • to respond to your inquiries or requests, including your customer service needs;
  • to improve RailEurope.com Site, including after research and analysis, for future marketing and/or promotional use about us or the products, services and features we may offer;
  • to survey visitors about various topics, including their views on travel, destination preferences, and what further travel information we might provide; and,

Information Uses Involving Third Parties

As noted above,  Rail Europe is a distributor of our Suppliers’ products and services, and, as a required part of travel, each of our Suppliers must have access to the names and age groups of each traveler for whom a pass or other ticket is purchased for its product or service. We do not provide this information to our Suppliers for their direct marketing purposes, and to our knowledge and belief, our Suppliers do not use the personal information we provide to them for reasons other than completing your travel-related transactions.

If you enter the RailEurope.com Site from the site of one of our marketing or referral partners, our system may recognize the path you have taken. Once you have left a partner’s site and/or begin the purchase transaction on RailEurope.com Site, those partners do not have access to the personal information you provide. Such information is treated as Data in accordance with this Privacy Policy. We also may track the path you have taken, combined with what purchases you may make, to gauge the success of our online marketing and promotional campaigns.

You may have an opportunity to provide information directly to these marketing or referral partners, whether through the RailEurope.com Site or on a partner’s web site, or to third parties who merely maintain links on the RailEurope.com Site. These third parties may maintain separate privacy policies governing the collection, use and disclosure of your personal information, which you should review for more information. As noted, from time to time, we may survey you for your opinion, offer participation in sweepstakes, and conduct reviews to enhance the RailEurope.com Site. We also send you newsletters to which you have subscribed. For each of these, we may rely on service providers to help us collect and analyze research, administer the sweepstakes, and provide technical support in sending the newsletters and other, similar emails. Cookie Use, Tracking Technologies, Digital-Media Player Software and Screen Sharing Software

A cookie is a small text file that is transferred to an individual’s hard drive for record-keeping purposes. You can set most browsers to notify you if you receive a cookie, or you may choose to block cookies with your browser. However, please be aware that some features of RailEurope.com Site may not function properly or may be slower if you refuse cookies.

Our cookies are typically session-oriented, or we use them to store info you’ve placed in a shopping cart when you visit our site during a select period of time. We also may use cookies to see what pages have been accessed and how frequently. Our tracking technologies also may record information such as Internet domain and host names; Internet protocol (IP) addresses; clickstream patterns; and dates and times that the RailEurope.com Site is accessed.

Rail Europe uses various ad networks to show online advertising on third party websites to users that have visited our website , a practice known as “re-marketing”. When you visit the Rail Europe website, these ad networks such as Google will set a cookie identifying you as having visited Rail Europe. When you visit another website that is also part of an ad network to whom Rail Europe subscribes to, you may see advertising targeted to you, based on actions you have taken while visiting the Rail Europe website.

Information on your activity on the Rail Europe website used by third parties to show personalized ads is stored on a cookie on your computer. This cookie doesn’t contain any personally identifiable information such as your name or email address and use randomly generated alphanumerical identifiers to identify you. Rail Europe doesn’t have access to those cookies and cannot use the information it contains.

Security for Personal Information

Wherever your Data may be held by us or on our behalf, we intend to take reasonable and appropriate steps to protect it from unauthorized access or disclosure. Each purchase of a Supplier’s travel product or service is subject to that Supplier’s rules and restrictions for each such product or service. Although most travel to the destinations offered by our Suppliers is completed without incident, travel to certain destinations may involve greater risk than others. We urge you to review travel prohibitions, warnings, announcements and advisories issued by the United States government prior to booking travel to international destinations. By offering of our Suppliers’ travel products and services for sale, we do not represent or warrant that travel to such points is advisable or without risk, and Rail Europe is not liable for damages or losses that may result from travel to such destinations.

You agree that your access to and interaction with rail-pass, ticket, and other travel-option and booking information available though the RailEurope.com Site is at your own risk, and Rail Europe will have no liability with respect to the acts, omissions, errors, representations, warranties, breaches or negligence of any Supplier, including, without limitation, any travel and/or accommodations provider, and/or for any personal injuries, death, property damage, or other damages or expenses resulting from your use or access to any Supplier or any Supplier’s products and services.

MAKING PURCHASES, REGISTRATION AND YOUR DATA

You may make a purchase through the RailEurope.com Site as either or a guest or by registering with us. In either case, you will need to provide certain information required for traveling, including your name, a valid shipping address in the United States, your email address, as well as the names of anyone traveling with you. Depending upon the product you are purchasing, you may be required to specify the age group into which you (or your travel companions) belong. With respect to all information you provide to us during registration or at the time of a purchase, you agree to provide us with: (i) accurate, current and complete address, email address and other registration information, and (ii)  your valid payment information, including credit card numbers and expirations dates (all such foregoing information, collectively, “Data”).  You agree to maintain and update your registered Data in a timely manner to keep it accurate, current and complete.  You agree that we may update your Data with information your bank or credit card issuer may supply.

You may only make purchases via the RailEurope.com Site if, and you hereby represent and warrant that, you are domiciled in the United States and you are 18 years old or older and the age of legal majority in the jurisdiction where you reside. You agree to pay in full the prices and any applicable taxes for any purchases you make either by credit or debit card or other permitted payment method. If payment is not received by us from your credit or debit card issuer, you agree to pay all amounts due upon demand by us. Rail Europe reserves the right to restrict the use of debit cards for purchase in its sole discretion. Except for certain payment card transaction fees that Rail Europe may be responsible for directly to your payment card issuer, you are responsible for any fees or charges that your bank, credit card or debit card issuer may apply.

You agree that you will not allow others to use your registered account or Data, and you are solely and entirely responsible for maintaining the confidentiality and security of both. Furthermore, you are solely and entirely responsible for any and all activities that occur under your account and you agree to immediately notify Rail Europe of any unauthorized use of your account or any other breach of security. Rail Europe shall not be responsible for any losses arising out of the unauthorized use of your account and/or Data, and you agree to indemnify, defend and hold harmless Rail Europe, its parent, subsidiary, affiliated and related companies, and each of its and their respective officers, directors, employees, representatives, contractors and agents for any claims, damages, costs, expenses or liabilities (including reasonable attorneys’ fees), resulting from or arising out of any improper, unauthorized or illegal uses of the same. You acknowledge and agree that we shall have no liability associated with or arising from your failure to maintain accurate Data, including, but not limited to, your failure to receive critical information about the RailEurope.com Site.

We may, at any time and in our sole discretion, with or without notice, cancel your account and disable your password in accordance with the terms set forth below (see Paragraph entitled “Use of the RailEurop.com Site and Content”). Further, our policy is to terminate members and accounts that have, or that we believe have, repeatedly or egregiously violated these Terms of Use.

PURCHASE AND TRANSACTION INFORMATION

SWEEPSTAKES, CONTESTS, GAMES, PROMOTIONAL OFFERS

Any sweepstakes, contests, games and/or promotional offers accessible on the RailEurope.com Site are governed by specific rules and/or terms and conditions (which are hereby incorporated into these Terms and Conditions by reference). By entering such sweepstakes or contests or participating in such games or promotional offers, you will become subject to those rules. We urge you to read the applicable rules and/or or terms and conditions, which are linked from the particular activity.

PROMOTION CODES/COUPON CODES

  1. Valid only for Online purchases, may not be used over the phone.
  2. One (1) coupon/code per purchase, per customer.
  3. Can not be sold or bartered, non transferable, no cash value, and cannot be exchanged for cash.
  4. To receive value of discount, the valid code must be entered in the Promotion Code/Coupon Code link on the payment page. If code is not entered the coupon cannot be redeemed and has no value. Due to technical problems, if the code is not accepted or Coupon link is not present, you have the right to not purchase the product, but in no circumstances will the credit be applied after purchase is made.
  5. Offer may be revised or withdrawn any time without notice, even if other sites are displaying the coupons.

  7. If the discount is not applied due to any reason on the checkout/credit card page, the credit/discount value is lost and can not be applied later.
  8. If the offer is withdrawn, the Promo Code/Coupon Code becomes invalid and the system will not accept the code when entered. This is final and you have the right at that point to continue with original price or not continue with purchase.

IN THE EXCEPTIONAL EVENT A COUPON IS NOT FUNCTIONAL, YOUR SOLE REMEDY, AND THE SOLE LIABILITY OF RAIL EUROPE SHALL BE THE REPLACEMENT OF THE NON-FUNCTIONING COUPON.
  12. Rail Europe, Inc. reserves the right to change these Terms and Conditions from time to time in its sole discretion. Void where prohibited by law.

You acknowledge that you do not acquire any ownership rights by downloading or printing copyrighted material as permitted by these Terms of Use. You may not add, delete, distort, use, copy, reproduce, republish, upload, post, transmit distribute or modify the Content in any way, in whole or in part, including in advertising or publicity pertaining to distribution of materials on the RailEurope.com Site, without the express, prior written consent of Rail Europe or the otherwise applicable owner. Any unauthorized attempt to do any of the foregoing without such consent, including, without limitation, the use of any Content on any other website or networked computer environment, any attempt to defeat or circumvent our security features, and/or to utilize the RailEurope.com Site or any part of the Content for any purpose other than its intended purposes, is and are strictly prohibited.

In addition to the Suppliers’ products and services, the RailEurope.com Site includes materials provided by such Suppliers, which is owned by or licensed to us by them. Such Suppliers’ company and product names are trademarks or service marks of the respective Supplier. All other marks are trademarks or service marks of Rail Europe, Inc. or its parent, subsidiary and/or affiliated companies.

USE OF THE RAILEUROPE.COM SITE AND CONTENT

You agree that you are using the RailEurope.com Site and Content for your own personal, non-commercial use, and not for transfer, assignment, resale, sale, lease, sublicense, rental, promotion, advertisement, redistribution or any other commercial use of any kind. Rail Europe reserves the right to enforce these Terms of Use with or without notice to you. We may, in our sole discretion, terminate these Terms of Use or terminate or suspend your access at any time without notice to you in the event that you breach (or we reasonably suspect that you have breached) any provision of these Terms of Use, engage in conduct which Rail Europe determines in its sole discretion is not in the best interests of Rail Europe or any other party; or you violate applicable laws. If Rail Europe terminates these Terms of Use, and/or terminates or suspends your access, you agree that Rail Europe shall have no liability or responsibility to you whatsoever.

Certain of the links we make available on RailEurope.com Site will direct you out of the RailEurope.com Site to a third-party site. You agree that we will not be responsible for, and do not endorse, the information, content, advertising, privacy policies, products, services, events, programs, code, and/or other materials on such linked web sites, whether or not Rail Europe is affiliated with the sponsors or operators of such sites or services. We encourage you to note when you leave the RailEurope.com Site. You should read and abide by all terms of use and privacy policies on any linked sites you access.

We appreciate linked referrals to our website, but require that you abide by our guidelines for trademark usage, standards of privacy of our customers, and other policies that we may set. Rail Europe reserves the right to demand, and you so agree, that immediately upon our notice to you, you will cease the use of our trademarks and any such referral links.

REGULATORY COMPLAINTS AND INFRINGEMENT

We will cooperate with any law enforcement authorities and comply with any judicial order requesting or directing us to disclose the identity of anyone accessing, transacting, registering, and/or otherwise using the RailEurope.com Site in violation of any applicable federal, state, or local laws.

If you believe that certain parts of the Content constitute an infringement of your copyright, you should notify us promptly and in accordance with the procedures described below. We will process claims of alleged infringement and will take appropriate action as required by the Digital Millennium Copyright Act (“DMCA”) when the following is sent to Rail Europe’s Copyright Agent:

  4. Information reasonably sufficient to permit the service provider to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted;

SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. If any of the above limitations do not apply to the extent applicable law may not allow the limitation or exclusion of liability for incidental or consequential damages, Rail Europe’s total liability for all losses, damages and causes of action in contract, tort (including without limitation, negligence), or otherwise will not be greater than the amount paid to Rail Europe for any and all products and services purchased on the RailEurope.com Site during the six (6) month period preceding the date the claim first arose.

Release of Liability: You agree to release, discharge, and hold harmless Rail Europe, its parent, subsidiary, affiliated and related companies, and each of its and their respective officers, directors, employees, representatives, contractors and agents (collectively, the “Released Parties”) from and against any claims, damages, expenses, and liability arising from or related to any injuries, damages, or losses to any person (including, without limitation, death) or property of any kind resulting in whole or part, directly or indirectly, from your use of, accessing, or participation in any feature of the RailEurope.com Site, including, without limitation, your breach of these Terms of Use or the use by us or our designees of any rights granted by you. You further release the Released Parties from and specifically acknowledge that the Released Parties are not liable for the defamatory, offensive, or illegal conduct of other RailEurope.com Site users or any third party, and that the risk of injury from the foregoing rests entirely with you.

INDEMNIFICATION

You agree to indemnify, defend and hold harmless the Released Parties against all losses, expenses, damages and costs, including reasonable attorneys’ fees, arising in any way from (i) your use of the RailEurope.com Site, (ii) your unauthorized use of any Content and/or Suppliers’ products and services, (iii) your breach or violation of applicable law or the Terms of Use, and/or (iv) any allegation that any submissions or other materials you submit to us or transmit to the Site infringe or otherwise violate the copyright, trademark, trade secret or other intellectual property or other rights of any third party. Rail Europe reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by you, and in such case, you agree to cooperate with Rail Europe in the defense of any such claim.

TERRITORIAL RESTRICTIONS

The RailEurope.com Site is controlled and operated by Rail Europe from its offices within the United States. Rail Europe makes no representation that materials available on the RailEurope.com Site are appropriate or available for use in other locations, and access to them from territories where their contents are illegal is prohibited. Those who choose to access the RailEurope.com Site from other locations do so at their own initiative and are responsible for compliance with applicable local laws. You agree to abide by applicable export control laws as well as all other applicable laws and regulations of the United States, and each of its states, localities and territories. Rail Europe reserves the right to verify the location of users and may use IP addresses as the basis for determining the location of its users.

NOTE THAT THESE TERMS OF USE ONLY APPLY TO THE USE OF THIS RAILEUROPE.COM SITE, AND OTHER WEBSITES PROVIDED BY RAIL EUROPE AND/OR RAIL EUROPE’S AFFILIATED COMPANIES HAVE DIFFERENT TERMS OF USE THAT APPLY TO THE USE OF THOSE SITES.

ARBITRATION

Please read this carefully. It affects your rights. Rail Europe and you agree to arbitrate all disputes and claims (including ones that already are the subject of litigation) arising out of or relating to this Agreement, or to any prior oral or written agreement, for Passes and Tickets and other services (collectively, “Services”) between Rail Europe and you. Notwithstanding the foregoing, either party may bring an individual action in small claims court. This Agreement evidences a transaction in interstate commerce, and thus the Federal Arbitration Act governs the interpretation and enforcement of this provision. A party who intends to seek arbitration must first send to the other, by certified mail, a written Notice of Intent to Arbitrate ("Notice"). The Notice to Rail Europe should be addressed to: Rail Europe, Inc., Attn: Legal Department, 44 South Broadway, White Plains, NY 10601 ("Arbitration Notice Address"). The Notice must (a) describe the nature and basis of the claim or dispute; and (b) set forth the specific relief sought ("Demand"). If we do not reach an agreement to resolve the claim within 30 days after the Notice is received, you or Rail Europe  may commence an arbitration proceeding. All issues are for the arbitrator to decide, including the scope of this arbitration clause, but the arbitrator is bound by the terms of this Agreement. The arbitration shall be governed by the Commercial Dispute Resolution Procedures and the Supplementary Procedures for Consumer Related Disputes (collectively, "AAA Rules") of the American Arbitration Association ("AAA"), as modified by this Agreement, and shall be administered by the AAA. The AAA Rules are available at www.adr.org or by writing to the Arbitration Notice Address. In the event the arbitrator finds in your favor, Rail Europe will pay all AAA filing, administration and arbitrator fees for any arbitration initiated in accordance with the notice requirements above. If, however, the arbitrator finds that either the substance of your claim or the relief sought in the Demand is improper or not warranted, as measured by the standards set forth in Federal Rule of Civil Procedure 11(b), then the payment of all such fees shall be governed by the AAA Rules. In such case, you agree to reimburse Rail Europe for all monies previously disbursed by it that are otherwise your obligation to pay under the AAA Rules. In no event, however, may the arbitrator award you an amount greater than the monetary jurisdictional limit of the New York City Civil Court Small Claims Part at the time of your claim or such amount as has been last offered by Rail Europe in settlement of your claim, whichever is higher. The arbitrator may make rulings and resolve disputes as to the payment and reimbursement of fees and expenses at any time during the proceeding and upon request from either party within 14 days of the arbitrator's ruling on the merits. You agree that, by entering into this Agreement, you and Rail Europe are waiving the right to a trial by jury. Unless Rail Europe and you agree otherwise, all hearings conducted as part of the arbitration shall take place in New York, New York. The arbitrator may award injunctive relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party's individual claim. You and Rail Europe agree that YOU AND RAIL EUROPE MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, and not as a plaintiff or class member in any purported class or representative proceeding. Further, you agree that the arbitrator may not consolidate proceedings of more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding, and that if this specific proviso is found to be unenforceable, then the entirety of this arbitration clause shall be null and void.

GENERAL

These Terms of Use constitute the entire agreement of the parties with respect to the subject matter hereof, and supersede all previous written or oral agreements between the parties with respect to such subject matter. A printed version of these Terms of Use and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to these Terms of Use to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. These Terms of Use shall be construed in accordance with the laws of the State of New York without regard to its conflict of laws rules, and shall be resolved individually, without resort to any form of class action. The parties agreeexpressly disclaim the application of the United Nations Convention on Contracts for the International Sale of Goods.

The parties irrevocably consent to submit to the jurisdiction of the state and Federal courts, as applicable, of the State of New York located in New York County, New York on matters arising out of these Terms of Use.  No waiver by either party of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default. If any provision of these Terms of Use is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of the Terms of Use remain in full force and effect.  If any provision of these Terms of Use is unlawful, void or unenforceable, the remaining provisions of these Terms of Use will remain in place.

ELECTRONIC COMMUNICATIONS; NOTICE

When you visit and use the RailEurope.com Site or send e-mails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by e-mail or by posting notices on this site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

Rail Europe may from time to time modify these Terms of Use and in such event we will post a copy of the amended Terms of Use at Policy page. If you do not agree to (or cannot comply with) the Terms of Use, as amended, your only remedy is to stop using the RailEurope.com Site. You will be deemed to have accepted the Terms of Use, as amended, if you continue to use the RailEurope.com Site after any amendments are posted.
